Ridesharing Laws in Florida

In May 2017, Governor Scott signed the Uber/Lyft Law, which requires those who drive for ridesharing companies or “transportation network companies” to meet minimum insurance requirements. The law requires these drivers to carry at least $50,000 for death and bodily injury per person, $100,000 for death and bodily injury per accident, and $25,000 for property insurance. The law also requires drivers to pass a background check that includes both their criminal and driving records. Ridesharing companies may not hire drivers who have been convicted of any of the following within the past five years:

  • Any felony
  • A misdemeanor for DUI, reckless driving, hit and run, or fleeing a police officer
  • Any crimes of lewdness or indecent exposure
  • A misdemeanor for sexual battery or any violent offenses
  • Driving on a suspended or revoked license

After an Accident in an Uber or Lyft

If you are involved in an Uber or Lyft accident, regardless of whether you are a passenger in the vehicle, there are a few important steps you should take. Be sure to document as much as possible after an accident by taking pictures, collecting contact information of anyone involved, and reporting the accident to law enforcement. Police can document the accident and place blame on the negligent party. If you were a passenger in the Uber or Lyft, you should take a screenshot of the driver’s information provided in the app. Do not speak directly to any representatives at Uber or Lyft, the driver, or their insurance company. Additionally, be sure not to post anything about the accident on social media, as this can harm your case. If you decide to take legal action against the negligent party, be sure to do so within four years of the date of the accident.
